Understanding the Pact Act for Vape Shops

The PACT Act has been a huge part of running a business in the vape industry for the past few years. It has spawned a variety of rumors that have led to businesses thinking they will no longer be able to purchase vape products on a wholesale basis.

But the reality is that not many people actually understand what the PACT Act really means for vape shops and other vape-related businesses.

What Is the PACT Act?

The Jenkins Act was passed in 1949 and acted as the precursor to what we know today as the PACT Act. It was a law meant to regulate tax avoidance and illegal tobacco sales. The law was later amended in 2009 and called the Prevent All Cigarette Trafficking Act (PACT).

Contrary to the Jenkins Act, the PACT Act requires tobacco product distributors to register with the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) and it also made it obligatory for businesses to keep a record of product shipments.

Further amendments to the act have been made since 2020.  Perhaps most important to this amendment was the addition of Electronic Nicotine Delivery Systems (ENDS) to the shipping ban list. This change specifically targets the distribution of cigarettes and other tobacco products by prohibiting USPS to ship ENDS products as of October 21, 2021.

Since this amendment came into effect, other private shipping companies like UPS, FedEx, and DHL have imposed vape shipping restrictions as well. This, with the intention of avoiding potential fines, was also prompted by the increased taxes on vape shipping which makes it a very expensive activity for carriers. Not to mention that filing regulatory documents is not a process that has been made any easier by the PACT Act.
