What Is Tobacco Free Nicotine?
Tobacco-Free Nicotine is nicotine that is made in a lab. In other words, it is synthetic. This is why tobacco free nicotine is also called synthetic nicotine. And because it is synthetic and does not use any organic material (like the tobacco plant), it’s completely tobacco free.
On the other hand, natural nicotine, or tobacco-derived nicotine, is extracted from the tobacco plant and other sources which have nicotine (tomatoes, aubergines, and potatoes).
How is Synthetic Nicotine Different from Tobacco-Derived Nicotine?
The main difference between synthetic nicotine and tobacco derived nicotine is that synthetic nicotine is man-made while tobacco-derived nicotine uses the tobacco plant. Some manufacturers have claimed that because synthetic nicotine is man-made, it is virtually tasteless and odorless and has fewer impurities than tobacco derived nicotine (Jordt, 2021).
Another important difference is that nicotine is what’s known as a chiral molecule, meaning it has two versions. With tobacco-derived nicotine, you’ll always get the S-nicotine version which is stronger and purer, but when synthesizing nicotine, you can get both versions of nicotine, R-nicotine and S-nicotine. Tobacco-free nicotine can either be a combination of R-nicotine and S-nicotine or only S-nicotine.
The main difference between synthetic nicotine that uses both R-nicotine and S-nicotine, is that it is half as potent as S-nicotine. So for example, if I were to have get a vape juice with R and S tobacco-free nicotine that has 6mg, I would actually be getting only 3mg of the standard S-nicotine.
Finally, synthetic nicotine is different from tobacco-derived nicotine in the fact that it costs much more to manufacture than tobacco derived nicotine. This is one of the reasons why synthetic has not been adopted by the mainstream even though it has been around since the 1960s (Jordt, 2021).
Similarities Between Tobacco-Free and Tobacco Nicotine
If we were to look at the chemical formula of both tobacco free nicotine and tobacco nicotine (or nicotine derived from tobacco), we would see that they are exactly the same. Both of them would show ten carbon atoms, 14 hydrogen atoms, and two nitrogen atoms. This is important because it means they have the same effects on the body.
Is Tobacco Free Nicotine Safe?
Because synthetic, or tobacco-free nicotine, hasn’t been around for a while, it’s hard to say if it is 100% safe. While it is true that the effects on the body are the same, like for synthetic nicotine that uses the combination of R and S-nicotine, the effects aren’t fully understood since R-nicotine hasn’t been studied extensively.
Benefits of Synthetically Produced Nicotine
According to one of the manufacturers of synthetic nicotine, Next-Gen Labs, there are two primary benefits of tobacco-free nicotine:
- It is tasteless and odorless, meaning you experience a fuller flavor and richer aromatic experiences when vaping.
- It has fewer impurities than tobacco derived from nicotine, which is extracted using chemicals
Is TFN Subject to FDA Regulation?
The main reason why tobacco free nicotine has risen in popularity in the last few years is that it lives in a legal grey area. With the FDA denying the PMTAs of more than five million tobacco products (Ducharme, 2021), vape manufacturers are looking for ways to continue selling their vape juices, and they believe tobacco free nicotine is the answer.
This is because many believe tobacco free nicotine is outside the regulatory power of the FDA. In 2009 a law was passed called the Tobacco Control Act. In this law, the government effectively gave the FDA authority to regulate tobacco products which included vape devices and products. However, to many, the definition used in the act to categorize tobacco products left out synthetic nicotine products. The Tobacco Control Act states that tobacco products are:
“made or derived from tobacco that is intended for human consumption, including any component, part, or accessory of a tobacco product.”
Since synthetic nicotine products are not “made or derived from tobacco” but instead made in a lab, they fall out of the scope of the definition.
However, the FDA is aware of synthetic nicotine products and has already addressed the issue in a FAQ page found on their website. In this frequently asked questions page, the issue is addressed as follows:
“The product I manufacture contains no substance made or derived from tobacco, e.g. is zero-nicotine, or has synthetic nicotine or nicotine made from tomatoes. Is my product subject to FDA regulation?
The definition of "tobacco product" includes any product made or derived from tobacco, including any component, part, or accessory of a tobacco product. E-liquids that do not contain nicotine or other substances made or derived from tobacco may still be components or parts and, therefore, subject to FDA's tobacco control authorities.
However, it’s possible that a disposable, closed system device that contains an e-liquid with truly zero nicotine (or synthetic nicotine) would not be regulated by the FDA as a tobacco product, if it is not intended or reasonably be expected to be used in such a fashion. FDA intends to make these determinations on a case-by-case basis, based on a totality of the circumstances.”
As you can see, their answer seems to be contradictory. First, they state that it ‘may’ still be subject to FDA’s tobacco control authority and in the following sentence they state that it’s possible for disposables, at least ones that contain zero or synthetic nicotine, to not be subject to FDA regulation. But it ends by saying the FDA will evaluate products on a case-by-case basis.
Why Should You Invest in Tobacco-Free Nicotine
At the moment it seems like vape manufacturers whose PMTAs are rejected by the FDA have three options. The first option is to go out of business. The second is to fight the decision in the court of appeals. The third is to start using tobacco free nicotine in all their products. Since almost five million vaping products have already been denied, and considering the FDA has yet to address synthetic nicotine directly, many manufacturers opt to make their e-liquids using synthetic or tobacco free nicotine.
So the question of whether or not you as a vape shop owner should invest in tobacco-free nicotine products is not really a question but more of a necessity since a large portion of the market is already using synthetic nicotine in their products.
Is TFN the Future of Vape Juice?
Whether or not tobacco free nicotine is the future of vaping remains to be seen. The manufacturing costs of synthetic nicotine are way more expensive than nicotine derived from tobacco, which means manufacturers will have to raise their prices, forcing customers to face the question of how much are they willing to pay for their vaping hobby.
There’s also the point to make that sooner or later the FDA will address the synthetic nicotine loophole. They might try to expand the definition of tobacco products in the Tobacco Control Act to include ‘man made nicotine’ or they might even treat and regulate it as a drug. In short, it would be silly to think the FDA isn’t already thinking of a way to control synthetic nicotine. But as we stated before in this blog, while not sustainable in the long run, synthetic nicotine is a lifeline that currently seems to be working and is giving vape manufacturers more time to find better solutions.
Vape Companies making TFN
Currently, there are two companies making synthetic or tobacco free nicotine. The first is Next Generation Labs, which focuses on making the combination R-nicotine and S-nicotine that is half as potent as nicotine derived from tobacco. In fact, they hold the patent for this type of synthetic nicotine. And then there is the German based nicotine manufacturer Contraf-Nicotex-Tobacco, or CNT, who exclusively makes the purer, or ‘superior’, S-nicotine.
